You’ll see stories about “6 out of 40,” “some charges dismissed,” etc. So here’s the real rundown.
There are three sections of charges against him — racketeering, soliciting oathbreakers, and fake electors. Soliciting oathbreakers just got thrown out entirely. This was frankly the most dangerous part. The fake electors thing is going to be thrown out of the SCOTUS, if not earlier. It’s exactly what happened with Nixon/Kennedy, and the “fake” electors then turned out to be the real electors. There’s no way for it to be the right legal move when you win the court case but a crime if you don’t. That’s now how our court system works. You are allowed to be wrong as long as you do it in court.
Racketeering stems out of combination of the other two. Forgery/whatever is just a crime. It already has its own punishment. You don’t get to call it organized crime without showing the organized part, and doing something once doesn’t rise to that.
The oathbreaking was also the most dangerous part because it was the most sexy to a jury. There’s taped phone calls, there’s famous people, there’s “did he / didn’t he,” all that. The rest? I’ve always kinda wondered why a PMC didn’t just decide to invade and take it over. I mean get enough vets together with just their personal weapons and surplus humvees and you could take the place. Obviously would have to take Port Au Prince first to unload everything, but once you’re on the ground there the locals are completely lacking in training.
