There are no stated penalties for not following that Flag Code section, however flying the flag upside is supposed to be an indication of “dire distress”. So they probably could arrest the person for a false report of an emergency if they wanted to, similar to how they can arrest people for calling 911 when it’s not an actual emergency.

Every time I read a story like this one I automatically assume the reverse is true. The PERP in this story is actual the VICTIM. The COPS in the story are actual CRIMINALS who were going in to take someone out. And the victim knew it and fought back. An honest question for AC.
